SUBSCRIPTION AGREEMENT

Please note that our devices, needed to be connected to the internet in order to work.

  1. The necessary device, equipment, peripherals and accessories (“Device”) that may be required to access and avail of the services may be a Packaged or a Purchased Device from Sakura Smart. Devices that was obtained by Subscriber from other sources cannot be used with Sakura Smart app.
  2. Subscriber shall be solely responsible for the Packaged or Purchased Device upon its delivery to him/her. Subscriber shall keep the Bundled or Purchased Device in good condition, wear and tear exempted.
  3. By accepting a Packaged Device or a Purchased Device delivered to Subscriber, Subscriber confirms that he/she has inspected the Device and found the same to be in good order and working condition.
    Should any Device provided by Service Provider be defective, the same may be replaced in accordance with the return policy except in the following cases:
    • The Device has been subjected to abnormal or negligent use; improper storage; exposure to moisture or dampness, excessive temperature or abnormal environmental conditions
    • unauthorized modifications, connections, or repair
    • There are visible dents, scratches, markings or signs indicated that the Device was dropped
    • There is a liquid or greenish residue
    • The Device’s has been altered
    • There are softwares or features not normally present in the original Device
    • Any other instance showing that the Device’s flaw is not a factory defect
  4. Users can subscribe to any package available within Sakura's website. Sakura only accepts subscription within the website
  5. Any additional devices will be computed accordingly and will be added to the base monthly fee of the chosen package
  6. A 24-month lock-in period will be applied to all new subscribers. After the 24-month period, all devices that are included in the package will be owned by the subscriber.
  7. After 24 months, subscribers can still continue to use the service without fees.
  8. In case of damage to or loss of the Packaged or Purchased Device, subscriber can choose to have the device replaced but with an additional fee
  9. Access to Premises - The Subscriber shall grant the duly authorized personnel of Sakura access to the Subscriber's premises for maintenance and inspection purposes.
  10. Transferability - All Sakura's Services, the Customer Premises Equipment including any of the foregoing terms and conditions may not be leased, assigned or transferred by the Subscriber within the 24-months of contract.
  11. Termination/Processing Fee - Service termination requests not otherwise due to the fault or negligence of Sakura shall take effect within reasonable period from receipt by Sakura of request. Appropriate termination penalty and/or processing fee for Sakura's Services termination will be calculated. The devices should be returned to Sakura and the fees will be calculated based on the condition of the items returned plus service fees.
  12. Billing - Sakura sends the monthly bill to subscribers by paypal or paymaya only.
  13. Payment - The subscriber allows Sakura to automatically deduct from their account the amount equivalent to their monthly subscription fee.
